老師性騷擾學生 竟不得解聘

桃園林姓國中教師用臉書向學生要電話號碼、約吃冰，被認定涉及性騷擾而遭解聘、三年不得聘任；他認為學校的處置有瑕疵，提行政訴訟請求撤銷處分；台北高等行政法院審理認為他的行為構成性騷擾，但情節非屬重大，撤銷解聘處分，仍可上訴。

林姓教師前年十一月廿日遭班導師通報在教學過程中，疑似對學生有不恰當身體碰觸、索要電話號碼及臉書帳號並邀約吃飯，讓學生感到不舒服；校方當天介入了解，教評會決議停聘、靜候調查，並把本案報請桃園市政府教育局核准。

林認為處置不公，訴願被駁回後，提起行政訴訟；他主張，他和學生的談話沒性意涵，因電腦輸入法容易出現同音不同義的字句產生誤會，才請學生留電話。他說他用詼諧語氣和學生談話，並非用加分、及格等條件要求學生約會，不符合教育部所頒布「不受歡迎的性要求」規定，校方的處分有瑕疵。

校方反駁，林一直向學生要電話，並常在深夜私訊學生，臉書也有許多像男女之間追求、試探性曖昧言語等不該是師生對話內容，因此決議成立性騷擾。

>法院認為，學校性平會組成的委員會調查認定林姓教師有性騷擾行為，但情節需重大才能解聘；林的情節並非重大，所以不得解聘。
